Vacant as in no troops? It's still either "owned" by a player or neutral, so it shouldn't display the Fog layer I wouldn't think.

I believe this. View only will show as if there is no fog, so who owns it and troop count.

Yep that's right. I've modified the code just haven't had a chance to test it thoroughly.
Risky - a view only border would show the fill layer in this instance.
View only borders now show seat and unit count whatever the fog setting.
ps Kjeld - re: your points about combining border types, unfortunately I made a poor design decision early on in that borders are defined as being of only one type or another, really a border should have a set of attributes all of which can be turned on or off independently of each other, e.g. attack / fortify / view / artillery etc. This could be remedied and retro-fitted into the existing design system but it will be quite time consuming to do and right now it's not a high priority.

Correct in all 3.
And just to expand on the View+Fortify thought, you can NOT have double borders (meaning a View and a Fortify to the same territory).
